These terms govern participation in the FlawLuxe Creator Program (the "Program"), operated by FlawLuxe ("we," "us"). By applying to or participating in the Program, you agree to these terms.
1. Eligibility & Approval. You must be 18 or older. We may approve, deny, or remove any participant at our sole discretion, at any time, with or without cause. One account per person.
2. Commissions. You earn a commission on qualifying sales made through your unique referral link or discount code, at the rates published in your affiliate dashboard. Commission rates, tiers, and bonuses may be updated by us with notice via the dashboard, email, or our creator community; changes apply to sales made after the change takes effect, never retroactively to confirmed commissions.
3. Qualifying Sales & Confirmation. A sale qualifies when a customer completes a purchase through your link or code and does not cancel, return, or charge back the order. Commissions are held as pending for 30 days after the order (matching our guarantee window) and are confirmed thereafter. Refunded, cancelled, disputed, or fraudulent orders do not earn commission and may be reversed from pending balances.
4. Excluded Orders. The following do not earn commission: your own purchases (including purchases using your creator discount), purchases made with your code by members of your household, orders flagged as fraudulent, and orders placed through coupon-aggregator traffic (see Section 7).
5. Payouts. Confirmed commissions are paid via the payment method you select in your dashboard, on the schedule and above the minimum balance published there. You are responsible for keeping your payment details current. Unclaimed balances due to missing or incorrect payment information are held until corrected. You participate as an independent contractor, not an employee, and you are responsible for your own taxes. US participants may be asked to submit a W-9 before payout, and we may issue tax forms as required by law.
6. Content & Disclosure Requirements.
(a) All promotional content must include a clear disclosure of your material connection to FlawLuxe (e.g., #ad, #commission) in accordance with FTC Endorsement Guides and platform rules.
(b) Content must not be deceptive, must not make untrue claims about products, and must not infringe anyone else's rights (including music, footage, or likeness you don't have rights to use).
(c) Content must not include anyone who has not consented to appear, and must not include minors.
(d) You may not represent yourself as an employee or official representative of FlawLuxe.
7. Prohibited Conduct. The following result in immediate removal and forfeiture of pending commissions: posting or distributing your discount code on coupon, deal, or cashback websites or forums; bidding on FlawLuxe trademarks or brand terms in paid search; sending spam; self-referral schemes; generating fake, incentivized, or bot traffic; and any manipulation of tracking.
8. Content License. You keep ownership of the content you create. By participating in the Program, you grant FlawLuxe a worldwide, royalty-free, perpetual, transferable license to use, reproduce, edit, adapt, and distribute content you create in connection with the Program — including on our social channels, in paid advertising, on our website, and in marketing materials — with or without attribution. This license survives your departure from the Program for content created while participating. If you do not want a specific piece of content used in advertising, tell us in writing and we will make reasonable efforts to exclude it going forward.
9. Brand Use. We grant you a limited, revocable license to use the FlawLuxe name and logo solely to promote FlawLuxe products under these terms. You may not register domains, social handles, or paid ads implying you are FlawLuxe.
10. Termination. Either party may end participation at any time. On termination, confirmed unpaid commissions above the payout minimum are paid on the next payout cycle; pending commissions from qualifying sales confirm and pay normally unless termination was for violation of Sections 6–7, in which case pending commissions are forfeited.
11. Program Changes. We may modify or discontinue the Program at any time. Confirmed commissions earned before discontinuation will be paid.
12. Liability & Indemnity. The Program is provided "as is." To the maximum extent permitted by law, our total liability to you is limited to unpaid confirmed commissions. You are responsible for your own content and agree to indemnify FlawLuxe against claims arising from your content or your breach of these terms.
13. Disputes. These terms are governed by the laws applicable at our principal place of business. You agree to contact us first at the email below to resolve any dispute informally before pursuing other remedies.
